1. Introduction and Operator Identification

This document governs the terms of service, personal data protection policies, and the use of cookies on the fana.design website.

2. Terms of Service

2.1 Contract Formation

The contractual relationship between the Provider and the client is established based on a written order, confirmed by both parties (via email or other verifiable means). The order includes specifications of the scope of work, price, and delivery deadline.

2.2 Payment Terms

• The price for the work is payable in two parts: 50% advance payment before the start of work and 50% upon completion and delivery of the work.
• Invoice due date is 14 days from the date of issue, unless otherwise agreed.
• In case of late payment, the Provider is entitled to charge a contractual penalty of 0.5% of the outstanding amount per day of delay.

2.3 Delivery Timeline and Cooperation

The Provider will deliver the work within the agreed deadline, provided that the client supplies the necessary materials and cooperation in a timely manner. In case of client delay in providing materials, the delivery deadline is proportionally extended.

2.4 License and Copyright

The work created by the Provider is a copyrighted work under Czech Act No. 121/2000 Coll. Upon full payment, the client receives a non-exclusive license to use the work for the purpose for which it was created. The Provider reserves the right to display the work in their portfolio as a reference.

2.5 Warranty and Claims

The Provider is responsible for defects in the work for a period of 6 months from delivery. Claims must be made in writing to info@fana.design. Defects do not include changes caused by the client's or third party's intervention in the code, changes in the hosting environment, or obsolescence of third-party technologies.

3. Privacy Policy

3.1 Data Controller and Processing Purposes

The data controller of your personal data is the Provider (see section 1). We process personal data for the following purposes:

3.2 Scope and Sources of Data

Through the contact form on fana.design, we process the following data:

• Name / company name
• Email address
• Phone number (optional)
• Message text

We obtain data directly from you through the contact form or email communication.

3.3 Retention Period and Recipients

Your data may be shared with the following third parties:

• Google Ireland Limited, operator of Google Analytics 4
• Instantly.ai, email communication tool

Data from the contact form is not shared with other third parties and is used exclusively for communication between you and the Provider.

Billing data is retained for 10 years in accordance with Czech tax and accounting regulations.

3.4 Data Transfer to Third Countries

Some third-party services may process data outside the European Economic Area:

• Google Ireland Limited: data is primarily processed in the EU. In case of transfer outside the EEA, protection is ensured by Standard Contractual Clauses.
• Instantly.ai: based in the USA. Data protection is ensured by Standard Contractual Clauses.

3.5 Data Security

We have implemented reasonable technical and organizational measures to protect your personal data against unauthorized access, loss, destruction, or misuse.

3.6 Automated Decision-Making

We do not perform automated decision-making or profiling within the meaning of Art. 22 GDPR.

3.7 Data Subject Rights

In connection with the processing of personal data, you have the right to:

• Access your personal data
• Rectification of inaccurate data
• Erasure of data ("right to be forgotten")
• Restriction of processing
• Data portability
• Object to processing
• Withdraw consent to processing

4. Cookies

On your first visit to the website, you have the option to accept or reject the use of analytical cookies. Your choice is saved in the browser and is valid for 1 year. You can change your choice at any time by clearing your browser data for this website.

This legal information is governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

The Provider reserves the right to update these terms unilaterally. The current version is always available on this page.
